Statutory/Paid Family & Medical Leave Updates for 2025

The following state-mandated benefits have changed, as described below:
Social Security—effective 1/1/25
- Cost-of-living adjustment (COLA) for benefit recipients is 2.5%.
- Earnings maximum subject to SS taxes—has increased from $168,600 to $176,100.*
*Many state PFML programs also use this standard to cap the employee income amounts that are subject to required contributions for PFML coverage in those states.
California State Disability Insurance (CA SDI)—effective 1/1/25
- CA SDI plan design changes took effect in January 2025.
- The CA SDI/PFL weekly max benefit is $1,681 for 2025.
- The employee contribution rate has increased from 1.1% to 1.2%, with no cap on taxable wages (as in the prior couple years).
- The State Average Weekly Wage (SAWW) used to calculate the “threshold” for the two benefit calculation “tiers” is $1,704. So the “threshold” amount is $1,192.80 (.7 x $1,704).
- For employees earning $1,192.80 or less—SDI/PFL benefit is 90% of base period wages.
- For employees earning more than $1,192.80—SDI/PFL benefit is the greater of 70% of employee’s base period wages, or $1,073.53 (i.e., 63% of the SAWW).
Colorado PFML—effective 7/1/24
- The State Average Weekly Wage increased from $1,421.16 to $1,471.34. This affects the tiers used in the benefit calculation, even for in-flight claims, but does not increase the maximum weekly benefit.
Colorado PFML—effective 1/1/25
- The withholding rate of .9% of wages has remained in place, to a maximum wage cap of $176,100.
- The maximum annual employee contribution is $792.45.
- The maximum weekly benefit is $1,324.21.
Connecticut PFML—effective 1/1/25
- Minimum wage increased from $15.69 per hour to $16.35 per hour.
- The earnings “threshold” that determines how the benefit will be calculated is now $654 (40 x $16.35).
- Maximum weekly benefit has increased from $941.40 to $981.
District of Columbia PFML—effective 7/1/24
- The new employer contribution rate is .75% of wages.
- The minimum wage increased from $17.00/hour to $17.50/hour, which affects the tiers used in the benefit calculation.
- Maximum weekly benefit increased from $1,118 to $1,153.
Hawaii PFML—effective 1/1/25
- Maximum weekly benefit has increased from $798 to $837.
- Maximum weekly wage base has increased from $1,374.78 to $1,441.72.
- Maximum weekly employee contribution has increased from $6.87 to $7.21.
Maryland PFML—effective 4/25/24
The contribution start date has been delayed from October 1, 2024 to July 1, 2025. The benefit start date has been delayed from January 1, 2026 to July 1, 2026.
Massachusetts PFML—effective 1/1/25
- Maximum weekly benefit has increased from $1,149.90 to $1,170.64.
- State Average Weekly Wage (SAWW) has increased from $1,796.72 to $1,829.13.
- Employers with 25 or more employees—contribution rate remains at 0.88% of eligible wages.
- Employers with fewer than 25 employees—contribution rate remains at 0.46% of eligible wages.
New Jersey Temporary Disability Benefits (NJ TDB)—effective 1/1/25
- Employee contribution rate is .23% of taxable wages (there were no employee contributions required for 2024).
- Employee taxable wage base cap is $165,400.
- Employer taxable wage base is $43,300.
New Jersey Family Leave Insurance (NJ FLI)—effective 1/1/25
- Employee contribution rate has increased from .09% to .33% of taxable wage base.
- Employee taxable wage base cap is $165,400.
- Maximum annual employee contribution is $545.82 (.33% x $165,400).
New York PFL—effective 1/1/25
- The State Average Weekly Wage has increased from $1,718.15 to $1,757.19.
- PFL weekly benefits are capped at 67 percent of the SAWW, so the 2025 maximum weekly PFL benefit is $1,177.32, up from the 2024 maximum weekly PFL benefit of $1,151.16.
- The new PFL rate is 0.388% of an employee’s wages each pay period, up to and not to exceed an annual maximum employee contribution of $354.53. This is a 4% increase to the 2024 rate, which was .373% of wages, up to an annual maximum employee contribution of $333.25.
An interesting COVID-related note from the New York Department of Financial Services:
"This increase of 4.0% is comprised of (i) an increase of 5.0%, reduced by (ii) 1.0% to reflect the $15 million of excess COVID-19 Surcharge funds. That excess represents the amount of (a) the COVID-19 Surcharge included in the PFL premium rates for calendar years 2021 and 2022 for the COVID-19 risk adjustment pool required under Chapter 25 or the Laws of 2020, less (b) the aggregate COVID-19 claims paid from that pool during calendar years 2020 through 2024."

PFL & Disability Benefits Filings Announcement
The New York State Workers’ Compensation Board will be monitoring late proof of coverage (POC) transactions and will begin issuing penalties to disability benefits carriers for late POC filings starting August 1, 2025.

Oregon PFML—effective 7/1/24
- The State Average Weekly Wage increased from $1,269.69 to $1,307.17.
- The minimum weekly benefit amount increased from $63.48 to $65.36.
- The maximum weekly benefit amount increased from $1,523.63 to $1,568.60.
Rhode Island Temporary disability insurance (RI TDI)/Temporary caregiver insurance (RI TCI)—effective 1/1/25
- Taxable wage base has increased from $87,000 to $89,200.
- Employee contribution rate has increased from 1.2% to 1.3% of wages.
- Maximum annual employee contribution has increased from $1,044 to $1,159.60.
Washington PFML—effective 1/1/25
- New employee withholding rate for PFML has increased from .74% of wages to .92% of wages.
- Maximum weekly benefit has increased from $1,456 to $1,542.
- The minimum weekly benefit for PFML remains at $100.
- State Average Weekly Wage (SAWW) used for calculating benefits has increased from $1,618 to $1,714.
